These Terms of Service (“Terms”) govern your access to and use of the AimlessDev website and related services, including storefront, Discord-connected features, and hosted or digital products (collectively, the “Services”).

By creating an account, placing an order, or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

2. Eligibility and Accounts

• You must be at least 13 years old (or older if required by your local law) to use the Services.
• If you create an account, you must provide accurate information and keep it up to date.
• You are responsible for all activity under your account and for keeping credentials secure.
• We may suspend or terminate accounts that violate these Terms, applicable laws, or platform integrity.

3. Services and Product Scope

• We provide digital goods and/or managed service features, which may include game server related products, configuration tools, and account-linked resources.
• Product availability, features, and pricing may change at any time.
• We may modify or discontinue any part of the Services without liability, except where required by law.

4. Orders, Pricing, and Billing

• Prices are displayed in GBP (£) unless otherwise stated.
• By placing an order, you authorize us and our payment processor to charge the total amount, including applicable taxes and fees.
• We use Stripe for payment processing. We do not store full card numbers.
• You are responsible for providing valid payment information.
• We may cancel or refuse orders for fraud prevention, pricing errors, abuse, legal compliance, or service limitations.

5. Refunds, Cancellations, and Chargebacks

• Refund eligibility is described here and, if published, in our standalone Refund Policy.
• For UK consumers, you may have a 14-day cancellation right for distance purchases unless an exception applies.
• For digital content and digital services supplied immediately, you expressly request immediate supply and acknowledge that once supply starts, your cancellation right may be lost to the extent permitted by law.
• Unless required by law, digital or delivered services may be non-refundable once provisioned, delivered, or materially consumed.
• To request a refund, contact support@aimlessdev.co.uk with your order details.
• Unauthorized chargebacks, payment disputes made in bad faith, or abuse of refund systems may result in account suspension.

6. Delivery and Service Availability

• Delivery timelines are estimates unless explicitly guaranteed.
• We do not guarantee uninterrupted uptime or error-free operation.
• Scheduled and emergency maintenance may affect availability.
• We are not responsible for outages caused by third-party providers, including hosting, network providers, Discord, or Stripe.

7. Acceptable Use

You agree not to:

• Use the Services for illegal, fraudulent, or abusive activity.
• Attempt unauthorized access, exploit vulnerabilities, or interfere with system integrity.
• Reverse engineer or misuse proprietary features except where permitted by law.
• Harass, threaten, or impersonate others.
• Circumvent account limits, bans, payment controls, or abuse protections.

We may investigate violations and take action including suspension, termination, and legal reporting.

8. Intellectual Property

• The Services, software, branding, text, graphics, and related content are owned by us or our licensors.
• Subject to these Terms, we grant you a limited, non-exclusive, revocable, non-transferable license to use the Services for personal or internal business use.
• No ownership rights are transferred to you.

9. Third-Party Services

Our Services may integrate with or depend on third parties (for example Stripe and Discord). Your use of those services may be governed by their terms and policies. We are not liable for third-party systems or content.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE RELEVANT SERVICE DURING THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

12. Indemnification

You agree to defend, indemnify, and hold harmless Aimlessdev LTD and its affiliates, officers, employees, and agents from claims, losses, liabilities, and expenses arising from your use of the Services, your violation of these Terms, or your violation of law or third-party rights.

13. Termination

We may suspend or terminate access to the Services at any time for violation of these Terms, legal risk, abuse, fraud concerns, or operational reasons. Sections that by nature should survive termination will survive.

14. Governing Law and Dispute Resolution

• Venue/jurisdiction: Courts of England and Wales
• You and we agree to attempt informal resolution before filing formal claims.

If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

15. UK Consumer Rights

Nothing in these Terms affects your mandatory statutory rights, including rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

16. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted unless otherwise stated. Continued use of the Services after updates means you accept the revised Terms.
